ACCEPTANCE OF TERMS
By using the Website or App, you signify your acceptance of the Terms and Conditions. If you do not agree to this, please refrain from using the Website or App. Your continued use of the Website or App following the posting of changes to these terms will indicate your acceptance of those changes.
GENERAL STATEMENT ON PRIVACY, PERSONAL DATA, AND COMMUNICATIONS
If you use the Website or the App, you are responsible for maintaining the confidentiality of your account, password, and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account and password.
You agree that BODYROK is in no way responsible for the safekeeping of your personal belongings while you are present in the studio. You assume all risk of loss for any of your personal belongings.
Member Services & Policies
YOU MUST BE PHYSICALLY PRESENT AT THE START OF YOUR SCHEDULED CLASS OR YOUR SPOT MAY BE GIVEN TO A WAITLISTED CLIENT.
Class Packages – As stated in the membership agreement, YOU MUST CANCEL CLASS 12 HOURS IN ADVANCE OR YOU WILL BE DEDUCTED THAT CLASS. This includes switching time slots under the 12-hour notice time period. You may cancel class prior to the 12-hour notice time period through our online system.
Contracts or Unlimited PACKAGES – Members who purchase ANY membership, contract or Unlimited packages (such as, but not limited to 8 Times Per Month, Recurring Unlimited Packages, Prepaid Unlimited Packages, or future promotional programs or membership packages) are subjected to a penalty charge. A $20 No-Show fee will be charged if you do not show up for your class. A $15 Late Cancel Fee will be charged for a cancellation less than 12-hours prior to the start of class. No EXCEPTIONS.
BODYROK reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders, at its sole discretion.
STUDIO RULES AND REGULATIONS
- All classes, and membership packages are non-transferable and non-refundable. No exceptions.
- Be on time.
- Keep the Chit Chat to a minimum.
- Crashers – Please wait on the bench until the instructor has asked you to join the class.
- No shoes are permitted on the BODYROK Reformers. Grip socks are suggested but not required.
- Towels are provided, but please leave them before you ROK out the front door.
- Please cancel class using your online profile. Please do not rely on email or calling the studio.
- Reserved classes must be changed or canceled prior to 12 hours before its scheduled time or depending on your package (i) it will be forfeited or (ii) you will be charged a No-Show or Late Cancel Fee.
- Students may not vary from instructed exercises.
- All injuries must be reported to your instructor before each class.
- If it’s your 1st class you should arrive at least 10 minutes prior to class to complete our waiver and get. If you are not physically present at the start of your scheduled class, your spot may be released.
LIMITATION OF LIABILITY
By signing up for and/or attending classes, events, activities, and other programs and using the premises, facilities and equipment (individually and/or collectively, the “Classes and Facilities”)
By signing your initial “Waiver” contract and/or attending classes, events, activities, and other programs and using the BODYROK studio facilities and equipment, (individually and/or collectively, the “Classes and Facilities”) you hereby acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in the strenuous nature of the BODYROK workout program. You acknowledge that you have voluntarily chosen to participate in a program of intense physical exercise. You acknowledge that BODYROK strongly recommends that you consult with your physician prior to commencing any class. You also acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. You further acknowledge that the specific risks vary from one activity to another, but range from (1) minor injuries such as scratches, bruises, and sprains; (2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions; and (3) catastrophic injuries including paralysis and death. At all times, you shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to you by trainers and staff. In consideration of being allowed to participate in and access the BODYROK classes and studio facilities, you hereby (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to the BODYROK classes and studio facilities, (2) release, indemnify, and hold harmless BODYROK, subsidiary affiliate entities and franchisees, and each of their respective members, employees and representatives and agents, and each of their respective successors and assigns and all others, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the BODYROK classes or BODYROK studio facilities, and (3) represent that you (a) have no medical or physical condition that would prevent you from properly using any of BODYROK’s classes and studio facilities, (b) do not have a physical or mental condition that would put you in any physical or medical danger, and (c) have not been instructed by a physician to not participate in physical exercise. You acknowledge that if you have any chronic disabilities or conditions, you are at risk in participating in BodyRok classes and use of studio facilities, and should not be participating in any classes.
INTELLECTUAL PROPERTY RIGHTS
The trademarks and trade dress of BODYROK are proprietary to BODYROK and may not be used by you for any reasons other than as expressly permitted by these terms. All Website and App content, design, text, graphics, and interfaces; the collection, selection, and arrangement thereof; and all software are property of, or duly licensed to, BODYROK. You have the right to view, electronically copy, and print in hard copy portions of the Website and App for the sole purpose of making class reservations, purchases, or other personal use.
Any other use of materials on the Website, including modification, distribution, or reproduction for purposes other than those noted above, without the prior written permission of BODYROK, is strictly prohibited.
“BODYROK” and other graphics, logos, wordmarks, and designs are trademarks of BODYROK in the U.S. and/or other countries for which applications are pending. BODYROK trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without the prior written permission of BODYROK.
In order to make a reservation, you must first own a single class a series (multiple classes) or Membership Series / Contract (Unlimited Recurring or Prepaid Unlimited). To buy an individual class or series online, you can either sign up on the BODYROK website by using your email and creating a profile, or if you are already registered, click login to buy a package and make your reservation.
You should be aware that classes and series expire, and future prices are subject to change. We accept MasterCard, Visa, and American Express. Cash payments may only be made in a BodyRok studio. You can reserve classes online up to 30 days in advance (schedule is released on the 1st of every prior month).
Your credit/debit card will be charged for your order when you submit your reservation or in connection to your specific Membership Contract (Examples: Recurring Unlimited, Rolling 10-Pack or 8 Times/Month). BodyRok will not process reservation charges that use an incorrect, expired, or over-the-limit credit card. We will make our best efforts to contact you if this occurs. If you fail to pay any fees or charges when due, services or privileges may be suspended or terminated. You shall be responsible and liable for any fees, including attorneys’ fees and collection costs, that BODYROK may incur in its efforts to collect any unpaid balances from you. LINKS/THIRD PARTY WEBSITES
BodyRok has not reviewed all the sites linked to the Website and/or App, and is not responsible for the content or any off-site pages or other linked sites. Although a third party website and/or app may contain the BodyRok logo, understand that it is independent from BODYROK, and that BODYROK has no control over the content of that website and/or app.
Going to third party or off-site websites from the Website and/or App is at your own risk. These links do not imply endorsement of, sponsorship of, or affiliation with BODYROK.
This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of California, USA, without giving effect to any principles of conflicts of law.
CHANGES TO THIS AGREEMENT
We reserve the right, at our sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Service.
We encourage you to review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
